An upstate man is in jail after being charged with engaging a child under 18 for sexual performance, WYFF4 reported January 10.
The assault was reported as taking place between December 26 and January 2.
According to South Carolina Law Title 16-1-60
“producing, directing, or promoting sexual performance by a child (Section 16-3-820); sexual exploitation of a minor first degree (Section 16-15-395); sexual exploitation of a minor second degree (Section 16-15-405); promoting prostitution of a minor (Section 16-15-415); participating in prostitution of a minor (Section 16-15-425); aggravated voyeurism (Section 16-17-470(C))”
Sexual misconduct with a minor is considered a violent crime in South Carolina, punishable by up to 30 years in prison. Since two children were involved, this will likely increase since each child can be considered a separate act and charged accordingly.
Exall is being held at the Spartanburg Detention Center.
